Bankruptcy

If you are facing oppressive financial debts beyond your abilities to pay, don’t make matters worse by failing to take action. Baldwin & Briscoe, P.C. can help you by considering all the options that are available to you, including bankruptcy. Bankruptcy is a valid tool the law has made available for individuals unable to meet their financial obligations. Every bankruptcy must be declared and filed in federal bankruptcy court. If you have any questions or wish to discuss the bankruptcy process in greater detail, please do not hesitate to contact our office to schedule a consultation. Baldwin & Briscoe, P.C. represents clients in chapter 7 and chapter 13 bankruptcies.

Bankruptcies We Represent

Chapter 7
Also referred to as “liquidation,” chapter 7 bankruptcy involves the selling of your assets by a trustee to meet your financial obligations. Debts that remain unmet after the completion of the sale of your assets are discharged, with some exceptions (such as child support and alimony payments). Not all of your assets are necessarily required to be sold under chapter 7 bankruptcy. Some specific assets, such as your house and vehicle, may be retained if you can continue to make payments on them after the bankruptcy.

Chapter 13
Chapter 13 bankruptcy is for individuals with regular income above the “means test” who nonetheless find themselves strapped by financial debt. In a chapter 13 bankruptcy case one of our lawyers will create a structured payment plan for you that specifies the payments you will make to your creditors over the course of several years. The payment plan will be filed with a bankruptcy court.

Foreclosure

Turn to a competent, local attorney for help if you face the possibility of foreclosure on your home. Attorneys at Baldwin & Briscoe, P.C. have years of experience representing the interests of home owners.  We can guide you through the legal process of foreclosure and ensure that your rights are respected at every step. By negotiating with your lender our attorneys can forestall the process and find a fair resolution to the situation. If you have any questions or uncertainties regarding a pending or potential foreclosure action on your home, do not hesitate to call our office to schedule a consultation.

Short Sales

Short sales are one method to avoid losing your home in foreclosure. The short sale operates by selling your home to a new homeowner before your lender completes the foreclosure. Though not a possibility in every case, consult with us to see if it is one of the options available to you.

Tax Sales

If you have taxes on a property you own that go unpaid, the state receives a lien on your property. The lien is only removed once the outstanding taxes have been paid. If the lien on your home becomes large enough, the state has the right to take control of your property and sell it in a tax sale.  If this becomes a possibility to you, do not hesitate to contact a lawyer and arrange for representation. We can work to slow or halt the tax sale by working with government in the courts, giving you time to work out any outstanding taxes you have with the state.

Mortgage Modification

A mortgage modification is an agreement between you and your lender to change the terms of your mortgage before or during foreclosure. If you are struggling to make payments on your mortgage or are already falling behind, or if you have recently undergone a financial hardship, a mortgage modification may be an option available to you. As a homeowner, you have the power to negotiate with your lenders. Baldwin & Briscoe, P.C.’s attorneys can help you understand your rights and options as they deal with your lender on your behalf. Though mortgage modification is a complex procedure, reaching a successful resolution with your lender can lower your monthly payments, preserve your credit rating, and prevent the threat of foreclosure on your home.

Refinance

A refinance is another means to reduce your monthly payments. Separate from mortgage modification, a refinance restructures the payment plan or interest rate of your current mortgage. Deciding whether a refinance or a mortgage modification is the option in your best interests is an important choice. Baldwin & Briscoe, P.C.’s attorneys can help you make the best decision by highlighting the benefits and costs of each option in light of your financial situation.

Debt Collection

In recent years debt collection has become a complex sphere of law for both debtors and creditors. As debts between private individuals and organizations have become both larger and more common the law has become murkier. Whether you owe or are owed money, Baldwin & Briscoe, P.C. can help you reach a resolution with your opposite parties. Our lawyers have years of experience representing the interests of both debtors and creditors in debt collection cases, and we will work tirelessly to ensure that you are treated fairly and professionally in your matter. We will negotiate with the opposite party to reach an understanding of your situation, all the while ensuring that each step you take complies fully with the established laws and regulations of the field.
