Also referred to as “liquidation,” chapter 7 bankruptcy involves
the selling of your assets by a trustee to meet your financial obligations.
Debts that remain unmet after the completion of the sale of your assets are
discharged, with some exceptions (such as child support and alimony payments).
Not all of your assets are necessarily required to be sold under chapter 7
bankruptcy. Some specific assets, such as your house and vehicle, may be
retained if you can continue to make payments on them after the bankruptcy.
Chapter 13 bankruptcy is for individuals with regular income
above the “means test” who nonetheless find themselves strapped by financial
debt. In a chapter 13 bankruptcy case one of our lawyers will create a
structured payment plan for you that specifies the payments you will make to
your creditors over the course of several years. The payment plan will be filed
with a bankruptcy court.
