As an employee you have certain rights protected by local, state and federal laws.  Depending on the size of your employer, you have the right to equal employment opportunities—application and pre-employment procedures, hiring, promotions, wages, hours and conditions of employment, job training and disciplinary procedures—regardless of your gender, pregnancy, age, religion, disability (see below for additional legal protections for those with disabilities), national origin, ancestry, genetic makeup or sexual orientation.  You may even be entitled to accommodations for your disability or religious practices.  These laws may also protect you from workplace harassment on the basis of any of these characteristics.  In addition to these anti-discrimination laws, employees may also have the right to:

 

·       Minimum wages and maximum hours

·       Compensation for workplace injury

·       Safe and healthy environment in which to work

·       Unemployment benefits

·       Report certain legal violations without retaliation (whistle blowing)

·       Medical leave for yourself or a member of your family

·       Freedom to organize, encourage and support an employees union

Disability Rights

Persons who have physical or mental impairments—whether due to genetics, disease, illness or injury—are not only protected from discrimination, they may also be entitled to particular accommodations so that they can enjoy equal access to and benefits of employment, housing, places open to the public, and educational institutions.  Various state and federal laws require employers, landlords, providers of public goods and services and schools (both primary and secondary) to make reasonable accommodations for a person with disabilities.  Some examples of reasonable accommodations include:

 

·       Adjusting work schedules

·       Transfer to another position for which employee is qualified

·       Allowing break time or limiting work hours

·       Allowing unpaid leave

·       Providing assistive devices or otherwise altering the work space

·       Alternative communication of business offerings to those who are deaf or blind

·       Admitting service animals in restaurants and other public places

·       Allowing extra time to complete a pre-employment exam or college admission test

·       Providing one-on-one services to students in public school (Individual Education Program or IEP)

·       Allowing the installation of a wheelchair ramp to an apartment

·       Allowing service or “emotional support” animals in a no-pet apartment community

·       Providing assigned parking to an apartment resident with  mobility impairments

 

In addition to the requirement that landlords make certain accommodations and allow certain modifications so that a tenant with a disability can enjoy the property, apartment communities built after 1991 must include particular features for accessibility, such as minimum door width, sidewalk slopes, and sufficient floor space in kitchens and baths.

 

Consumer Rights

Whether you are simply visiting a local restaurant or movie theater, applying for a credit card, looking to buy a home or rent an apartment, applying to college or hoping to invest your hard-earned money, consumers are afforded a host of protections under state and federal law.  The following are just some of the protections you may have as a consumer:

 

·       Equal access to housing, credit, education, and public accommodations without regard to gender, disability, race, sexual orientation, national origin, ancestry and marital status

·       Certain disclosures pertaining to credit terms

·       Prohibition of certain mortgage terms, such as balloon payments or pre-payment penalties

·       Prohibition of certain debt-collection practices
